Jurisdiction Case Review
State v. Ringquist, 433 N.W.2d 207 (N.D. 1988)
This case is about the issuance of a state search warrant to search the premises of Ringquist for illegal drug sales. The case is in the state court system, meaning that the “law” of the case must be one which a state court has jurisdiction to hear. The case is being heard by the Supreme Court of the state of North Dakota, which is a state court. Further, although the case involves the discussion of due process and search and seizure civil rights under the Fourteenth and Fourth Amendments to the United States Constitution that is not the main issue which the court is deciding. The court is, instead, deciding whether the warrant obtained by the officers to investigate the occurrence of a violation of state illegal drug laws, was obtained in violation of the state’s constitution and the kind of probable cause required under the state’s constitution to issue a search warrant.
