History:
Modern day jails and prisons function with the same basic principles as was used in England and America in the eighteenth-century, even though the jails had little to do with punishment in England. In America there was very little difference between the two corrections systems, a noticeable difference however was in the use of capital or corporal punishment. American courts handed out the death sentence much more frequently than England’s courts did. There were people even then that fought against torture, mutilation and death for convicts, there was a law for a time that only allowed the death sentence in pre-meditated murder cases this law has been used and lifted over time. However, this is much as it is today.
Purpose:
