Plea Bargaining: A unique remedy to reduce backlog in Indian courts

Getting involved in a court case is quite unfortunate as it is an unending legal meandering corridor. The criminal justice system in our country is a slow process. Our cluttered legal system takes almost a quarter to half time of the individual’s lifetime to conclude a case. The slow, cumbersome and long trials i.e. there are absence of rapid disposal of cases which results in the backlogged courtrooms. Approximately backlog of court cases in Supreme Court stands 33,635, High Court 33, 41,040 and subordinate courts 2, 53, 06,458.

According to National Crime Research Bureau Study, nearly 2, 20,000 cases took more than 3 years to reach court and about 25,600 exhausted 10 years before they were completed. Also the time between arrest and trials is inordinately long, which affects the conviction rate. To declutter the system, the Indian Government has passed the law of plea bargaining and inserted a new chapter......
