To appeal is to ask a higher court to overturn the decision of a trial court after the final judgement. The appellant, Kasmin, was charged with the offence of indecent assault. The offence occurred on June 15th 2004. The accused pleaded not guilty and the issue proceeded to trial before a magistrate, the magistrate found the appellant guilty and was convicted and sentenced on the 1st of January 2005; to 8 months imprisonment- the sentence was not suspended, the defendant then made an appeal.
